Terms of Service

The ground rules.

Agreement

These Terms of Service ("Terms") govern your use of getownly.app and the Ownly mobile application (together, "Ownly" or the "Service"). Ownly is operated by Adam Proceviat Digital (operated by Adam Proceviat), British Columbia, Canada ("we," "us," or "our").

By accessing or using Ownly, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

What Ownly is

Ownly is a personal ownership system that helps you organize what you own, reflect on purchases, plan wishlists and bundles, and maintain the things that matter. Ownly is provided for personal, non-commercial use unless we agree otherwise in writing.

Eligibility

You must be at least 18 years old to create an account or use Ownly. By using the Service, you represent that you are 18 or older. We do not knowingly allow under-18 users. If we learn an account belongs to someone under 18, we may delete it.

Accounts and security

You may need an account to use certain features. You are responsible for the accuracy of the information you provide, keeping your login credentials secure, and all activity under your account. Notify us promptly at support@getownly.app if you believe your account has been compromised.

Your content

You retain ownership of the content you submit to Ownly, including item details, photos, notes, ratings, purchase details, wishlists, bundles, check-ins, care reminders, and similar materials ("Your Content").

By submitting Your Content, you grant us a limited, worldwide, non-exclusive license to host, store, process, display, transmit, and back up that content solely as needed to operate, maintain, secure, and improve the Service.

You are responsible for Your Content and for ensuring you have the rights to upload it. Do not upload content that is illegal, infringing, harmful, or that violates someone else's rights.

Acceptable use

You agree not to:

  • Use Ownly for unlawful, deceptive, or abusive purposes
  • Attempt to access other users' accounts or data without permission
  • Interfere with or disrupt the Service, servers, or networks
  • Reverse engineer, scrape, or misuse Ownly except as allowed by law
  • Upload malware or attempt to bypass security or rate limits
  • Use Ownly to spam, harass, or harm others
  • Misrepresent your age or identity to access the Service

Subscriptions and payments

Ownly may offer free and paid features. Pricing, limits, and Premium benefits may change over time. If you purchase a subscription through the Apple App Store, Apple processes payment. Apple's payment terms, billing cycle, auto-renewal rules, and cancellation process also apply. Manage or cancel subscriptions in your Apple ID / App Store subscription settings. We may use RevenueCat to manage subscription entitlements.

Except where required by law or by Apple's refund policies, fees are generally non-refundable. If you are a consumer in the EU/EEA (or another region with mandatory consumer protections), nothing in these Terms limits rights that cannot be waived under applicable law, including any mandatory withdrawal or refund rights that may apply.

Intellectual property

Ownly — including its name, logo, design, software, and branding — is owned by Adam Proceviat Digital / Adam Proceviat and protected by intellectual property laws. These Terms do not give you ownership of the Service. You may not copy, modify, distribute, or create derivative works from Ownly except as expressly allowed.

Third-party services

Ownly relies on third-party services for hosting, authentication, storage, payments, crash reporting, and (where enabled) analytics — including providers such as Supabase, Apple, RevenueCat, and crash/analytics vendors. Your use of those services may also be subject to their terms and privacy policies.

Disclaimers

Ownly is provided "as is" and "as available." To the fullest extent permitted by law, we do not guarantee that the Service will be uninterrupted, error-free, or that insights, estimates, reminders, or recommendations will be complete or accurate. Ownly is a tool to help you organize and reflect on ownership — it is not financial, legal, insurance, tax, or other professional advice.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service.

Our total liability for any claim related to Ownly will not exceed the greater of (a) the amount you paid us for Ownly in the 12 months before the claim or (b) $50 USD. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protections.

Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless Adam Proceviat Digital and Adam Proceviat from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of Ownly, Your Content, or your violation of these Terms or applicable law.

Termination and account deletion

You may stop using Ownly at any time. You can delete your account in the app via Settings → Account → Delete Account. Deletion is immediate and irreversible from your side. If you cannot complete in-app deletion, email support@getownly.app.

We may suspend or terminate access if you violate these Terms, misuse the Service, are under 18, or if we discontinue Ownly. Upon termination, your right to use the Service ends. Provisions that should reasonably survive (including ownership, disclaimers, liability limits, indemnity, and governing law) will continue to apply.

Canceling a subscription through Apple stops future billing according to Apple's rules; it does not automatically delete your Ownly account or data unless you also delete your account.

Governing law and venue

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Subject to the next sentence, the courts located in British Columbia, Canada have exclusive jurisdiction over disputes arising out of these Terms or the Service.

If you are a consumer, mandatory consumer protection rights in your country of residence (including in the EU/EEA) remain unaffected where they cannot be waived, and you may be entitled to bring proceedings in your local courts.

Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use of Ownly after changes take effect means you accept the updated Terms. If changes are material, we may also provide additional notice in the app or by email where appropriate.

Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding Ownly and supersede prior agreements on the same subject.
